Awards & Breaches

Who enforces a Party Wall Award?

Surveyors make awards; they are not a general enforcement agency. Serious non-compliance can ultimately require court involvement.

Start with practical compliance

Most issues are best dealt with by identifying the clause, asking for correction and involving the surveyors where a genuine statutory dispute remains.

Surveyors can determine, not police every action

Their role is to resolve matters within the Act, not to supervise the site continuously or impose criminal penalties.

Court remedies may sometimes be needed

If a material requirement of the award is ignored and practical/statutory routes do not resolve the issue, legal advice may be required about enforcement or other civil remedies.

Proportionality matters

Court action over a minor historical breach that has been corrected may cost far more than it achieves.

Key takeaway

Focus first on securing compliance and preventing harm; consider formal enforcement only where the issue genuinely justifies it.
